RE: The tariff classification of silicon dioxide from Japan

Dear Mr. Seo:

In your ruling request dated March, 4, 2013, on behalf of your client, Small Axe Corporation, you requested a tariff classification ruling on silicon dioxide.

The product at issue is described as a light gray, odorless, powder. The submitted documentation further indicates that the product’s composition consists of 95-97% silicon dioxide (CAS no. 7631-86-9) and 3%-5% water (CAS No. 7732-18-5). You have indicated that the product is intended to be used as engine treatment powder.

The applicable subheading for silicon dioxide will be 2811.22.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other inorganic oxygen compounds of nonmetals: Silicon dioxide: Other. The general rate of duty will be free.

This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which are administered by the U.S. Environmental Protection Agency.
